The DOL is redefining who is an employee and who is an independent contractor. The EEOC is changing PWFA regulations, dropping harassment guidance and directly soliciting white men to rat out employers using diversity, equity and inclusion practices. Not to be outdone, the NLRB is changing handbook rules—again. This comes on the heels of an already challenging employment law landscape for HR professionals due to changes made in the Supreme Court’s 2024-25 term.

Anniken Davenport is an attorney and a well-known author and speaker on employment law issues. She is the senior legal editor for HR Employment Law Advisor and has authored several books, including The FMLA Compliance Guide, Bullet-Proof Your Employee Handbook and the Employer’s Practical Legal Guide. Anniken has served as a professor at Penn State University, where she taught business law and HR management, and she directed the Legal Studies Program at Wilson College.
