Among employees who took leave for a qualifying FMLA reason, about a third (31%) took multiple occasions of leave for the same reason, “intermittent leave”—at a rate higher than in 2012 (24%). In that same period, according to the latest data available, average intermittent leave for qualifying FMLA reasons came in at about 21 business days total across those occasions.—DOL, 2018 data

As use of FMLA leave increases, it’s no surprise that some of HR’s thorniest, legally riskiest situations involve employees’ use (and abuse) of FMLA leave taken in small bites. The detail and timing necessary to administer intermittent leave can confuse even the most seasoned HR professionals. Plus, because employees are becoming well versed in the FMLA game, your organization is paying the price. It’s up to you to know the law—and your CEO will expect it.

On Tuesday, October 28, find out how to confidently handle every intermittent FMLA question thrown at you. We’ll tell you how to prevent and correct FMLA compliance problems and effectively manage all types of FMLA intermittent-leave issues. This includes properly certifying the need for intermittent leave so it’s only used for its intended purpose and not turned into personal leave on demand. Plus, learn how to coordinate FMLA intermittent leave used during pregnancy and time off under the Pregnant Workers Fairness Act to minimize disruption and avoid double-dipping.

Our promise: By the end of this webinar, you will feel much more comfortable and confident balancing workplace needs with your legal FMLA obligations.

Webinar Agenda

Understand “real world” FMLA scenarios. We’ll explain how to manage the common FMLA problems you face daily and how to avoid potential legal pitfalls associated with overlapping state and federal leave laws.
Use compliance tools correctly. Learn how to use the tools of compliance to address unscheduled and intermittent leaves (certifications, call-in rules, attendance procedures and more), and how to account for intermittent leave by the hour. It’s not as simple as you think.
Proper certifications. Know what to do—and what not to do—when FMLA call-offs exceed the intermittent-leave certification you have on file (there’s new legal guidance).
When to say no. Employees can use intermittent leave every day to change their schedule permanently. Know if and how you can say no to such demands.
Know how to track time off. The FMLA and the PWFA allow pregnant workers short bursts of unscheduled leave. Learn how to track both concurrently.
Learn lessons from recent court rulings. They lay out a path for the best (and worst) steps to complying with intermittent-leave laws.
Identify the key questions to ask. You should ask a certain set of questions each and every time an employee seeks leave.

Answer any questions about leave. One wrong employee-leave decision can trigger a career-crushing lawsuit.

Avoid mistakes. Managing small bites of leave is the hardest part of the FMLA.

Manage intermittent leave. Employers have rights, too. Learn how to manage intermittent leave to your advantage.
